Terms of Service

These Terms govern your use of the SwingPolls apps and website (the “Service”). By creating an account or using the Service you agree to these Terms. If you don’t agree, don’t use the Service.

1. Eligibility and accounts

• You must be at least 13 years old (or the minimum age in your country) to use SwingPolls.
• Give accurate information, especially the profile details used for poll targeting. Misrepresenting your age, location or other attributes to vote on polls you are not eligible for is not allowed.
• You are responsible for your account and for keeping your password secure. One person, one account.

2. Your content

You own the polls, photos, videos and other content you post. You grant SwingPolls a worldwide, non-exclusive, royalty-free licence to host, store, display, reproduce and distribute that content as needed to operate and promote the Service. This licence ends when you delete the content or your account, except for copies that others have already shared or that we must keep for legal reasons.

You confirm you have the rights to everything you post.

3. Acceptable use

Don’t use SwingPolls to post or do anything that:

• is illegal, hateful, harassing, threatening, sexually explicit, or exploits minors;
• infringes someone else’s intellectual property or privacy;
• spreads spam, scams or malware;
• manipulates results, for example with fake or multiple accounts, bots or paid votes;
• impersonates others or misleads people about who you are;
• interferes with, scrapes, or tries to break the security of the Service.

We may remove content and suspend or ban accounts that break these rules. You can report content in the app.

4. Verification

Verification confirms that an account belongs to a real person. It is not an endorsement. We may approve or reject verification requests at our discretion and may revoke verification if we believe it was obtained improperly.

5. Poll results

Polls on SwingPolls are opinion polls created by users. Results reflect the people who chose to vote and are not scientific surveys. Don’t rely on them for medical, financial, legal or other important decisions.

6. The Service

We are constantly improving SwingPolls and may add, change or remove features. We may suspend the Service for maintenance. The Service is provided “as is” and “as available”, without warranties of any kind, to the extent permitted by law.

7. Limitation of liability

To the extent permitted by law, SwingPolls is not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill, arising from your use of the Service. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim or USD 50. Nothing in these Terms limits liability that cannot be limited by law.

8. Ending your account

You can delete your account at any time in the app. We may suspend or terminate accounts that violate these Terms or where required by law. Sections that by their nature should survive termination will survive.

9. Changes to these Terms

We may update these Terms. If a change is material we will let you know in the app or by email. Continuing to use the Service after changes take effect means you accept them.

10. Governing law
